Account Application Terms & Conditions
1. Superseding Contract
This Agreement constitutes the entire agreement between the parties hereto with respect to the subject matter hereof and supersedes all prior agreements and understandings, oral, written and implied, between the parties hereto with respect to the subject matter hereof; provided, however, that this Agreement is a supplement to and in furtherance of the employment agreement between the parties and Indemnity and applicable law, and shall not be deemed a substitute therefore, nor to diminish or abrogate any rights of Indemnitee thereunder.
2. Entire Agreement
The Agreement sets out the entire agreement between the parties in relation to taxi transport services and supersedes all prior arrangements, undertakings, representations and warranties by or between the parties in relation to such Advertising.
3. Governing Law
This Agreement is governed by the law in force in Victoria and the parties submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria.
4. Force Majeure
If Eureka Taxis Western Victoria Pty Ltd (“Eureka Taxis”) is prevented from or delayed in complying with an obligation under this Agreement by an event beyond its reasonable control, including but not limited to a telecommunications failure, terrorist attack, war, national emergency, inclement weather, fire, flood, earthquake, natural disaster, change in legislation or shortage or destruction of equipment or materials by Eureka Taxis of the obligation will be suspended for the period of the delay and Eureka Taxis will not be liable for any loss or damage suffered by you arising from or relating to such delay.
5. Severability
If any provision of these Terms and Conditions or the Agreement is held illegal or unenforceable, then such illegality or unenforceability shall not affect the remaining provisions of these Terms and Conditions or Agreement which shall remain in full force and effect.
6. Privacy
Eureka Taxis collects your personal information to assist in providing the aforementioned taxi transport services. Eureka Taxis may also share the Client’s information with other persons or entities who assist Eureka Taxis in providing its services. Personal information will be dealt with in accordance with the provisions of the Privacy Act 1988 (Cth) and Eureka Taxi’s Privacy Policy.
7. General Terms
7.1 Eureka Taxis may at its own discretion, block, restrict or ban any customer, address or phone number from utilizing our services for any reason at any time for breaches of these terms and conditions.
7.2. A Cancellation fee of $10 per occurrence will be applied to a trip if the driver has commenced the job and or is on their way to your pickup location.
7.3. For any pre-booked jobs, the driver is entitled to start the meter at any point once making contact with the passenger. This could be via the automated text message, advising that the driver has arrived, or via telephone.
7.4. For school pickups, the meter will commence, from the time the driver arrives at the pickup point, and has to (if required) leave the vehicle to collect the student.
7.5. For the delivery of any parcel, click and collect or the pickup of any prearranged item(s), regardless of size weight or dimensions, Tariff 9 is used in conjunction with any and all other fees and charges such as applicable fuel levy, call out fee or premium booking fee (if applicable). Please ask your dispatcher for further information apon booking.
7.6. Time applies on each Tariff if the vehicle is traveling below 25km/h, is stationary waiting for customer in between stops or is loading / unloading passenger belongings between stops.
7.7. For 5-11 passengers (including a person(s) who uses a wheelchair or of other mobility aid) or where the hirer, specifically requests a larger then standard vehicle regardless of the number of passengers (except where the booking is for a person(s) who uses a wheelchair or other mobility aid).
7.8. Holiday rate applies all day Christmas Day, Boxing Day, New Year’s Day; and from 6PM on New Year’s Eve. It also applies from 7PM on the evenings prior to other Victorian public holidays until the morning of the public holiday for all unbooked fares and are from midnight to midnight for booked fares.
7.9 When the hirer specifically asks requests the hire of as premium service vehicle and agreed to the charge of up to $15 per trip.
7.10. Call out fees are charges in increments of $10. 0-10Kms = FREE 10-20Kms = $10, 20-30Kms = $20, 30-40Kms = $30, 40-50Kms =$40, 50-60Kms = $50, 60-70Kms = $60 70-80Kms = $80, 80+ / Melbourne Airport = $80 and $120 Melbourne city and beyond.
7.11 Fuel levy applies when returning from a long distant job to cover sundary expenses the ware and tare on the vehicle and the drivers time. Rates are as follows in increments 0-10Kms = FREE 10-20Kms = $10, 20-30Kms = $20, 30-40Kms = $30, 40-50Kms =$40, 50-60Kms = $50, 60-70Kms = $60 70-80Kms = $80, 80+ / Melbourne Airport = $80 and $120 Melbourne city and beyond.
7.12 Tolls (Both Eastlink & Citylink) are extra as per the signposted rates sticker in the vehicle and are added on top of the metered fare.
7.13 Administration fees are charges where any administrative works needs to be undertaken outside normal standard transport. This could be where ET needs chase up accounts or overdue invoices.
7.14. Not withstanding any other term and condition outlined in this document. Due to recent insurance changes and the introduction of safe lifting limits, any foldable wheelchair weighing more then 5kgs, must now be transported in our WAT/WAV taxis under Tariff 9,
7.15. Not withstanding section one above, or section twenty-one below, Eureka Taxis may, at its own discretion, block, restrict or ban any customer who steals or damages any of Eureka Taxis property. All violations of this form a reportable offense and will be reported to Safe Transport Victoria and Victoria Police.
7.16. MPTP / M40 cards can not be used in conjunction with any other transport concessions or subsidies. If a trip, or part of a trip, is covered by insurance (for example, by the Transport Accident Commission), or paid for by any state or Commonwealth department or agency, the MPTP card can’t be used. 7.17. Premium Services Booking Fee is only applied in the following situations:
7.17.1 When there is no vehicle rostered on; or a driver is called in; or
Our SUVs are converted from a 4 seater to to a 6 seater; and or
7.17.2 A booking is made outside our normal operating hours.
Before this fee is applied, customer consent is required. If customer consent is refused the booking can not proceed.
7.18 Not withstanding section one above, Eureka Taxis may, at its own discretion, block, restrict or ban any customer, address or phone number from utilizing our services for any reason at any time for abusive or threatening behavior. This includes but does not limit being disrespectful, rude or resulting in threatening or inappropriate behavior to our drivers, dispatchers , managers or supervisors.
7. General Terms
